Mark W. Epstein – Partner
Mark W. Epstein has more than three decades of experience as a trial lawyer in both civil litigation and as a San Francisco criminal prosecutor. Prior to joining Seiler Epstein, Mr. Epstein was an attorney with the law firms of Berg, Ziegler, Anderson & Parker and the international law firm of Graham & James. He also served as an Assistant District Attorney in San Francisco under then District Attorney Arlo Smith where he and the other founders of Seiler Epstein met.
While at Berg, Ziegler, Mr. Epstein focused on a wide variety of business and real estate litigation, construction law, eminent domain/inverse condemnation, probate disputes, employment matters and personal injury cases. He primarily represented financial institutions, real estate developers, private landowners and condemning agencies in eminent domain actions, employers and general contractors. Mr. Epstein’s practice at Graham & James involved the representation of financial institutions in commercial litigation matters, as well as the representation of developers, contractors and construction companies.
Mr. Epstein has completed nineteen jury trials in state and federal courts, obtaining successful verdicts in eighteen of the trials and is quick to clarify that in the one “unsuccessful” trial, it was a hung jury and upon retrying the same case, he obtained a favorable unanimous verdict after the jury deliberated for approximately 22 minutes. He has also represented clients in numerous bench trials where his clients have prevailed in each and every one of the trials. Mr. Epstein regularly represents clients in numerous state and federal courts, and has represented clients in countless arbitrations, mediations and administrative hearings.
